LCP successfully obtained Court Judgment and Writ Enforcing right of Child Development Teachers not to be Laid Off out of Seniority Order

Langenkamp, Curtis & Price successfully obtained a Superior Court Judgment and Writ in July, 2020 against the Sacramento City Unified School District on behalf of the Sacramento City Teachers Association. The Judgment and Writ orders the District to reinstate 4 Child Development Teachers whom the District laid off out of seniority order in violation of California Education Code section 8366. The decision establishes important seniority rights for Child Development and preschool teachers: the decision interprets Education Code section 8366 and makes clear that seniority for Child Development Teachers is based on the length of time served as a child development teacher in the District as a whole rather than the length of time in particular child development programs or subclasses. The Court's Order states, "In short, Section 8366 requires layoffs in order of seniority and without regard to position held."
